In one of the most incredible comebacks of the NFL season, the Tennessee Titans stunned the Miami Dolphins 28-27 on Monday Night Football. Ông Phan Chí Hiếu - Thứ trưởng Bộ Tư pháp cho biết, hiện nay có những nơi vẫn bối rối trong việc cấp giấy chứng nhận và quyền sở hữu đối với loại hình condotel.


Về giải pháp trước mắt, Bộ Tài nguyên và Môi trường và Bộ Xây dựng cần sớm xây dựng khung pháp lý về các thủ tục cấp giấy chứng nhận cho condotel.


"Hiện nay chúng ta vừa làm vừa lo khi chưa có khung pháp lý phù hợp. Trong điều kiện bình thường không sao nhưng khi cần thì sẽ có những thứ chưa được luật quy định và như vậy rất phức tạp", ông Hiếu nói.


Ông Mai Văn Phấn - Phó Cục trưởng Cục đăng ký đất đai (trực thuộc Tổng cục Đất đai) cho rằng, bản chất condotel nó chỉ là căh hộ khách sạn hay khách sạn chung cư. Vậy mục đích của nó là đầu tư để kinh doanh.


Do vậy theo điều 126, Luật Đất đai, đối với những trường hợp này (condotel - PV), thời gian giao đất 50 năm hoặc tới 70 năm. Cũng Điều 126 có hướng mở là khi hết thời hạn giao đất có quyền gia hạn nếu có nhu cầu. Về thời hạn, bản chất của condotel thì pháp luật có hướng mở là được gia hạn, ông Phấn cho biết.


Không thể có việc cấp phép vô thời hạn


Theo quan điểm của ông Đặng Hùng Võ – nguyên Thứ trưởng Bộ Tài nguyên và Môi trường thì cần xem xét mục đích sử dụng đất của dự án. Condotel thì chắc chắn là sử dụng vào mục đích kinh doanh.


"Như vậy quyền sử dụng đất 50 năm hay 70 năm, không có phương án khác. Nhưng thực tế là cần phải làm dài hơn. Nếu chúng ta nới thời hạn sử dụng condotel vô thời hạn thì chúng ta có thể sử dụng lâu dài", ông Võ nêu quan điểm.


Bên cạnh vấn đề cấp sổ đỏ, ông Võ cũng cho rằng, một chính sách nữa quan tâm mở rộng đó là cho phép cá nhân người nước ngoài được nhập cảnh vào Việt Nam mua bất động sản du lịch như nhà ở.


Trong khi đó, chuyên gia kinh tế Cấn Văn Lực cho rằng, bên Thái Lan, trong luật chung cư họ cho phép sử dụng những căn hộ khách sạn với 2 mục đích khác nhau nhưng để chuyển đổi thì phải có điều kiện đi kèm. Về thời hạn, ở Châu Âu có quy định cụ thể như nước Anh là 100 năm.


"Còn ở Việt Nam chúng ta chắc chắn không thể có việc cấp phép vô thời hạn, bởi như thế chúng ta không kiểm soát được và liên quan đến rất nhiều vấn đề khác", ông Lực nói.


Theo quan điểm của ông Lực, Chính phủ nên ban hành một nghị định xác định rõ hơn thuật ngữ condotel và cùng với đó là các điều kiện của loại hình này.


"Cần phải hoàn thiện khung pháp lý cho loại hình. Như vậy ngân hàng mới dám cho vay đối vợi loại hình này. 2 năm vừa qua, ngân hàng không dám cho vay đối với condotel vì tính pháp lý còn lỏng lẻo", ông Lực cho biết.
